1) Parties & Scope

These Terms & Conditions (the “Agreement”) are entered into by and between:

CHAITEN (SASU), share capital €10,000, SIRET 804 992 196 00035, VAT FR95 804992196, registered office: 16 rue Maurice Porra, 66000 Perpignan, France (the “Organizer”, “CHTN.XP”, “we”, “us”), and
you, on behalf of yourself and any person included in your booking (collectively, the “Participant”, “you”).

This Agreement governs your application, acceptance, participation, and payment for CHTN.XP experiences in mountainous environments (the “Experience”).

2) Mountain Risk

Mountain activities involve inherent and unpredictable risks, including (non-exhaustive): severe weather, avalanche, rock/ice fall, crevasse hazards, variable snow, altitude effects, falls, equipment failure, rescue delays, and serious injury or death. By participating, you acknowledge and accept these risks.

You agree to follow all safety instructions and to behave in a way that protects the group.

3) Application & Acceptance

3.1 Application-first
Participation is by application. Applying does not guarantee acceptance.

3.2 Acceptance
You are accepted only when you receive a written confirmation from us (email is sufficient) and complete any required steps (deposit/payment, forms, waivers, etc.).

3.3 Accuracy
You agree that all information you provide (skills, experience, health, emergency contacts) is accurate and up to date. Misrepresentation may lead to refusal or removal from the Experience without refund.

4) Experience Format & Conditions-Based Itinerary

4.1 Conditions dictate outcomes
The exact itinerary, routes, objectives, and daily program may change at any time due to weather, conditions, safety, group level, or operational constraints.

4.2 No guarantee of specific routes/lines
You understand the Experience is not the purchase of a specific summit, line, route, or achievement. It is a guided/hosted mountain experience where decisions prioritize safety.

5) Third Parties (Guides, Huts, Lifts, Transport, Rentals)

5.1 Third-party providers
Parts of the Experience may be provided by third parties (e.g., mountain huts/refuges, lift companies, transport providers, equipment rental, restaurants, etc.) (the “Third-Party Providers”).

5.2 Guiding
If the Experience includes guiding, it may be delivered by independent, duly qualified mountain professionalscontracted for the Experience. Additional waivers or terms may apply and may be required before participation.

5.3 Organizer role
We may facilitate coordination and/or collect payments for certain components; however, Third-Party Providers remain responsible for their own services, rules, and liabilities.

6) Pricing, Payments & Deposit

6.1 Price
Pricing and what is included/excluded are stated in your written booking confirmation (or annex).

6.2 Deposit & balance
A deposit may be required to secure your spot. The balance must be paid by the deadline stated in your confirmation. If you fail to pay on time, we may cancel your participation and apply the cancellation terms below.

6.3 Fees
You are responsible for any bank/wire fees and for providing proof of transfer when requested.

7) Cancellation, Refunds, Credits

7.1 Why cancellation rules are strict
CHTN.XP experiences rely on limited capacity, advance bookings, and professional staffing. Late cancellations create real losses.

7.2 Guest cancellation
Your cancellation is effective only when received in writing at: contact@agencechaiten.com.

7.3 Default cancellation policy (template)
Unless your confirmation states otherwise, the following applies:

  • More than 60 days before start: deposit retained OR converted to credit (Organizer’s choice)

  • 60 to 30 days: 50% of total price due (or retained if already paid)

  • 29 to 15 days: 75% of total price due

7.4 Credits
If we grant a credit, it must be used within a defined period (e.g., 12 months) and is subject to availability and potential price changes. Credits are not refundable.

8) Force Majeure & Mountain Reality

8.1 Force majeure / safety interruptions
We are not liable for delays, modifications, reduced activity, or cancellations caused by events beyond our control, including severe weather, avalanche risk, lift closures, hut closures, road closures, strikes, government orders, illness outbreaks, or rescue operations.

8.2 No automatic refunds for conditions
Because conditions are an inherent part of the Experience, you accept that itinerary changes or “reduced objectives” do not automatically create a right to a refund. We will act in good faith to adapt the program to safe alternatives.

8.3 Organizer cancellation
If we cancel the Experience entirely (other than due to force majeure), we will offer either:
(a) a refund of amounts paid to us for the Experience, or
(b) a credit, or
(c) a combination.
Third-party costs may be governed by their own refund rules.

9) Fitness, Skills, Equipment & Safety Conduct

9.1 Fitness & health
You confirm you are medically fit for strenuous mountain activities. You agree to inform us of relevant conditions (e.g., asthma, heart issues, severe allergies).

9.2 Equipment
You are responsible for arriving with the required gear list. Missing essential safety gear may result in exclusion without refund.

9.3 Alcohol/drugs
No participation under the influence. We may remove a participant for safety reasons.

9.4 Removal for safety
If you endanger yourself or others, or refuse safety instructions, we may exclude you from the Experience without refund.

10) Liability, Assumption of Risk & Insurance

10.1 Assumption of risk
You acknowledge mountain risk cannot be eliminated.

10.2 Insurance recommendation
We strongly recommend you have adequate insurance covering: rescue, medical costs, repatriation, and trip cancellation (“cancel for any reason” if desired). You remain responsible for verifying your coverage.

10.3 Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect losses (missed flights, extra nights, lost equipment, etc.). Nothing in this Agreement limits liability where limitation is prohibited by law.

11) Images & Content

Unless you opt out in writing, you grant us the right to use photos/videos captured during the Experience for CHTN.XP / Chaiten communication (website, social, press), without compensation. You may request removal of a specific image for legitimate reasons.

12) Personal Data

We process personal data for booking, safety, and communication purposes. More details are available in our privacy policy on agencechaiten.com.

13) Governing Law & Jurisdiction

This Agreement is governed by French law. Any dispute shall be submitted to the competent courts in France, unless mandatory consumer rules provide otherwise.

14) Acceptance

You accept this Agreement when any of the following occurs:

  • you sign it electronically or physically, or

  • you confirm acceptance by email, or

  • you pay a deposit or any part of the Experience price after receiving this Agreement.
